1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of the Cabiqo platform, including the web application, E-Shop, Planora design tool, Cut & Edge module and all related services (collectively, the "Platform") operated by Cabiqo Industries Private Limited ("Cabiqo", "we", "us" or "our"), registered in India.
By creating an account, placing an order or using any feature of the Platform, you confirm that you have read, understood and agreed to these Terms. If you do not agree, you must not use the Platform.
2. Definitions
- "User" means any individual or entity that accesses the Platform.
- "B2B Account" means a registered business account used for wholesale purchasing via the E-Shop.
- "Order" means any sales order, purchase order or E-Shop transaction placed through the Platform.
- "Content" means all designs, BOMs, cut lists, quotes and data generated through the Platform.
- "Planora" means Cabiqo's built-in space design and visualisation tool.
- "Cut & Edge Module" means the shop-floor cutting optimisation and edge-banding management feature.
3. Use of the Platform
You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
- Attempt to gain unauthorised access to any part of the Platform or its infrastructure.
- Use automated scripts, bots or scrapers to extract data from the Platform.
- Transmit any malicious code, viruses or disruptive software.
- Misrepresent your identity or business affiliation when registering for a B2B Account.
- Reproduce, resell or sublicense any Cabiqo software or content without written consent.
We reserve the right to suspend or terminate access for any violation of these restrictions.
4. User Accounts
To access most features of the Platform you must register for an account. You are responsible for:
- Providing accurate and up-to-date registration information.
- Maintaining the confidentiality of your login credentials.
- All activities that occur under your account.
You must notify us immediately at help@cabiqo.com if you suspect any unauthorised use of your account. Cabiqo will not be liable for losses arising from unauthorised use where you have failed to secure your credentials.
5. Orders & Payment
All orders placed through the Platform are subject to acceptance by Cabiqo or the relevant seller. We reserve the right to refuse or cancel any order at our discretion.
5.1 Pricing
Prices are displayed in Indian Rupees (INR) and are exclusive of GST unless stated otherwise. Cabiqo reserves the right to change prices at any time; however, the price at the time of order confirmation will apply to that order.
5.2 Payment Terms
Payment is due as per the invoice or checkout terms presented at the time of order. B2B accounts may be eligible for credit terms subject to prior written agreement. Late payments attract interest at 2% per month on the outstanding balance.
5.3 Cancellations
Manufacturing orders cannot be cancelled once production has commenced. E-Shop orders may be cancelled within 24 hours of placement provided goods have not been dispatched.
6. E-Shop & Marketplace
The Cabiqo E-Shop is a B2B procurement platform for interior designers, architects and modular furniture manufacturers. By using the E-Shop you acknowledge that:
- Products are sold for commercial or professional use and not for personal or household consumption.
- Minimum order quantities (MOQs) may apply to certain product categories.
- Bulk pricing tiers are applied automatically at checkout based on quantity.
- Product availability and delivery timelines are estimates and may vary.
- Imported products comply with applicable BIS and ISO quality standards where required.
Cabiqo's Best Price Guarantee applies to identical products available through verified Indian B2B suppliers. Price match requests must be submitted within 7 days of purchase with supporting documentation.
7. Delivery & Returns
7.1 Delivery
Estimated delivery timelines are provided at checkout and in order confirmations. Cabiqo endeavours to meet these timelines but is not liable for delays caused by third-party logistics providers, natural events or circumstances beyond our control.
7.2 Inspection
You must inspect all goods upon delivery. Claims for damaged, incorrect or missing items must be raised within 48 hours of receipt with photographic evidence sent to help@cabiqo.com.
7.3 Returns
Returns are accepted within 7 days for defective or incorrectly supplied goods. Custom-cut panels, bespoke orders and perishable adhesives are non-returnable. Approved returns are credited to your account or refunded within 14 working days.
8. Intellectual Property
All software, algorithms, designs, trademarks, logos and content on the Platform are the exclusive intellectual property of Cabiqo Industries Private Limited or its licensors. Nothing in these Terms grants you any rights to use Cabiqo's intellectual property except as expressly permitted.
Designs and BOMs created by users using Planora remain the property of the user; however, you grant Cabiqo a non-exclusive licence to process, store and display this data solely for the purpose of operating the Platform.
9. Data & Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform you consent to the collection and use of your information as described in the Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Cabiqo shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, loss of data, business interruption or loss of goodwill.
Cabiqo's total aggregate liability for any claim arising under or in connection with these Terms shall not exceed the amount paid by you to Cabiqo in the three (3) months immediately preceding the event giving rise to the claim.
11. Termination
Either party may terminate a subscription or account with 30 days' written notice. Cabiqo may suspend or terminate your access immediately if you breach these Terms, fail to make payment, or if continued access poses a security or legal risk.
Upon termination you may export your data within 30 days. After this period, Cabiqo reserves the right to delete your data in accordance with our data retention policy.
12. Governing Law
These Terms are governed by the laws of India. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
We encourage users to resolve disputes informally by contacting us first. For unresolved disputes, parties agree to attempt mediation before initiating formal legal proceedings.
